These general conditions of sale (hereinafter, "General Conditions") have as their object the regulation of the purchase of products and services, carried out remotely and made available, via the internet, from the website www.tiberino.com/shop ( hereinafter, the Site) in compliance with the Italian legislation on distance contracts (Legislative Decree 70/2003).

The Customer is required, before sending the order, to carefully read the General Conditions that have been made available to him on the Site to allow them to be reproduced and stored.

Contracts concluded with Sudalimenta srl ​​through the Site are governed by these General Conditions in compliance with Italian law. The language available to conclude the contract is Italian.

Choose and order the Products:

The characteristics and the price of the various Products are shown on the page relating to each Product.

To purchase the Products, the Customer must complete and send the order form in electronic format, following the instructions contained on the Site. The Customer must add the Product to the "Cart" and, after having read the General Conditions and the Privacy Policy, will have to enter the shipping and billing data, select the desired payment method and confirm the order.

By confirming the order, which has the value of a contractual proposal, the Customer acknowledges and declares that he has read all the information provided during the purchase procedure and that he fully accepts these transcribed General and Payment Conditions.

The contract stipulated between Sudalimenta srl ​​and the Customer must be considered concluded with the acceptance of the order by Sudalimenta srl. This acceptance is communicated to the Customer through an email confirming the order.

If the Customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity), once the online purchase procedure has been completed, he will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of Italian legislation on distance contracts.

Any right of the Customer to compensation for damages or compensation, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or things, caused by the non-acceptance or evasion, even partial, of an order is excluded.



Product Information:

Information relating to Products susceptible to distance selling is available, with the relative product codes, on the Site.

The visual representation of the products on the Site, where available, normally corresponds to the photographic image accompanying the description sheet. It is understood that the image of the products themselves has the sole purpose of presenting them for sale and may not be perfectly representative of its characteristics but differ in color and size. In the event of a difference between the image and the written product sheet, the description of the product sheet always prevails.



Prices:

Product prices are inclusive of all taxes and duties. All prices are expressed in Euros.



Shipments:

Shipping costs apply to all orders and vary according to the destination country. When the Customer selects a destination country other than Italy, the shipping costs will be automatically updated.

Confirmation of receipt of order:

Once the order has been received, Sudalimenta srl ​​will check the availability of the stocks for the fulfillment of the order. In the event that a product is not available, the Customer Service will promptly notify the Customer. The customer can decide whether to confirm the shipment or cancel it.

The Customer receives, upon execution of the contract, an email confirming receipt of the purchase order sent. The communication contains a summary of the general and particular conditions applicable to the contract, of the withdrawal, the order number, the summary of the shipping and billing data, the list of products ordered with their essential characteristics, their price and amount paid.



Transport and delivery:

The Products purchased on the Site will be delivered to the address indicated by the Customer during the purchase procedure, any error attributable to the incorrect indication of the address or data indicated on the door / intercom / bell that will prevent the courier from identifying the recipient of the shipment. , could cause delay in delivery and / or the charge of additional shipping costs; in these cases Sudalimenta srl ​​cannot be held responsible for any delay and / or further charge.

Sudalimenta srl ​​issues an invoice for the goods shipped for each order placed on the Site, and sends it to the Customer in paper or digital format only upon request received by email at info@sudalimenta.com, or by telephone at 080 5046600 (Mon-Fri 9.00 - 13.00 and 16.00 - 19.00). For the issuance of the invoice, the information provided by the Customer during the purchase procedure is valid. It will not be possible to make any changes to the invoice after it has been issued.

Any delivery costs are charged to the customer and are clearly highlighted during the purchase procedure.

All purchases will be delivered by express courier (hereinafter, "Courier") from Monday to Friday, excluding holidays and national holidays. Sudalimenta srl ​​is not responsible for unforeseeable delays.

Sudalimenta srl ​​will send the Customer a confirmation e-mail once the Products have been shipped, which will include a link to refer to for tracking the shipment.

In any case, except in cases of force majeure or unforeseeable circumstances, the ordered Products will be delivered within a period of 7 (seven) working days starting from the day following that in which the Customer sent the order to Sudalimenta srl, unless Sudalimenta srl ​​communicates - within the same term - the impossibility of delivering the ordered goods following the unavailability, even temporary, of the Products. In case of such communication, the Customer will have the possibility to choose one or more alternative products. In the event that the Customer decides not to choose alternative products or to cancel the order, Sudalimenta srl ​​will refund any sums already paid by the Customer within the same time frame.



Right of withdrawal:

Pursuant to art. 64 and ss. of the Consumer Code (Legislative Decree 2005/206), the customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty.

To exercise this right, the customer must send Sudalimenta srl ​​a communication within 10 working days from the date of receipt of the goods.

This communication must be sent by registered letter with return receipt, addressed to:

The communication via fax must also be sent within the aforementioned term of 10 working days and followed by a confirmation by registered letter with acknowledgment of receipt.

The Customer Service of Sudalimenta srl ​​will, once received the communication, communicate to the customer the instructions on how to return the goods.

The right of withdrawal is subject to the following conditions:

1. The law applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product.

2. By law, the shipping costs for returning the goods are charged to the customer.

3. The shipment, until the certificate of receipt in our warehouse is under the complete responsibility of the customer.

4. Sudalimenta srl ​​is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments.

5. In case of damage to the goods during transport, Sudalimenta srl ​​will notify the customer of the incident (within 5 working days), to allow him to file a complaint against the courier and obtain any refund. In this case, the product will be made available to the customer for its return at the same time canceling the request for withdrawal.

Sudalimenta srl ​​will refund the customer the full amount already paid, within 30 days from the return of the goods, through the refund procedure via Paypal or by bank transfer. It will be the customer's responsibility to provide the bank details on which to obtain the reimbursement (ABI Code - CAB - Current Account of the invoice holder).

The right of withdrawal is totally lost, due to lack of the essential integrity of the goods (packaging and / or its contents), in cases where Sudalimenta srl ​​ascertains:

1. The lack of the external packaging and / or wrapping containing the purchased product

2. Damage to the product for reasons other than its transport.

In case of forfeiture of the right of withdrawal, Sudalimenta srl ​​will return the purchased good to the sender, charging the shipping costs to the sender.


Lack of conformity:

In case of lack of conformity of Products sold by Sudalimenta srl, the Customer must immediately contact the email address info@sudalimenta.com

The legal guarantees provided for in articles 129, 130 and 132 of the Consumer Code apply to the sale of the Products. The Customer has the right to restore, without charge, the conformity of the goods by repair or replacement or to a suitable reduction in the price or to terminate the contract. The Customer loses these rights if he does not report the lack of conformity to Sudalimenta srl ​​within two months from the date on which he discovered the defect.



Errors:

The information relating to the Products provided through the Site is constantly updated, however it is not possible to guarantee the complete absence of errors.

Sudalimenta srl ​​reserves the right to correct errors, inaccuracies or omissions even after an order has been sent, or to modify or update information at any time without prior notice.

Applicable law and competent court:

The sales contract between the customer and Sudalimenta srl ​​is concluded in Italy and governed by Italian law. For the solution of civil and criminal disputes deriving from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference forum of his municipality of residence or of elective domicile if located in the Italian territory; in all other cases, the territorial jurisdiction is exclusively that of the Forum of Bari.
